France fines company for worker surveillance

The company implemented a scanning system that recorded the activities of its employees in real time, generating indicators on the quality of their activities, productivity, and downtime. The French DPA declared the inactivity measurement system illegal. It considered the system for measuring the speed of the scanner during the storage of objects to be excessive and found the retention of all data and statistics for 31 days to be disproportionate.

The Authority recognized the need to monitor employee activity due to the Company’s constraints and high-performance targets. However, it argued that the processing of data through scanners differed from traditional tracking methods due to the impact on the privacy of the data subjects, generating continuous pressure on employees.
