pablo escobar trademark denied

The Court of the European Union denied the registration of the trademark “PABLO ESCOBAR” filed by Escobar Inc. to identify multiple types of goods and services, including fragrances, food, financial and legal services.

In the ruling the Court upheld the decision stated by the EUIPO and considered that granting the trademark was against public order and good customs, as its name corresponds to that of an alleged drug lord and narco-terrorist.

This is not the first time that a trademark application “PABLO ESCOBAR” is denied by an authority, since in 2023 the CTO denied the trademark “MUSEO PABLO ESCOBAR By Nicolas Escobar”, intended to protect museum services, considering that it was also against public order and good customs. The foregoing, since the trademark would be associated as an apology to terrorism and would exalt the image of a person who generated much damage to society.
