Spain: Spanish trademark law reform goes into effect

15 January, 2019

On 27 December 2018, the Spanish Government enacted Royal Decree Law 23/2018, which reforms the current Trademark Law. This reform shall go into effect on January 14, 2019, except in certain sections that have specific terms of application.

The new Trademark Law will benefit companies and individuals, facilitating the coexistence of national brands with European Union trademarks, clearing the registration of unjustified trademarks. The reform seeks to accelerate procedures for the benefit of interested parties and to harmonize Spanish regulations with the European Parliament and Council in relation to the approximation of trademarklaws of Memeber States, allowing for proper internal market operation in the Union.
