COLOMBIA | Judicial Affairs, Procedural Law | Judicial deadlines are suspended in Colombia from 20 December 2016, until 10 January 2017

.

The above, in accordance with Article 146 of Law 270 of 1996 and article 20 of Decree 546 of 1971, which establishes that the majority of courts, judges and tribunals of the country will enter into collective vacations.

Accordingly, no judicial action can be exercised during that period, and those actions that must be filed before Judges in these days will be deferred up to the first business day of 2017 in judicial affairs (January 11).

COLOMBIA | Copyright | Colombian Supreme Court ratifies the judicial functions of the National Copyright Office

The Civil Chamber of the Supreme Court of Justice decided in favor of the National Copyright Office with a “tutela” (a writ of amparo) filed by Foxtelecolombia S.A. confirming the authority of the Judicial Affairs Sub-Directorate of the entity to carry out discovery requests and preliminary injunctions in issues related to copyright and related rights.

This transfer of jurisdictional authority to administrative authorities is extraordinary and must limit itself to concrete cases.

COLOMBIA | Copyright | Orange network: The new portal for publication of works sponsored by the Colombian National Copyright Office

On 5 December, 2016, the Colombian National Copyright Office announced the release of the web portal Orange Network, which will allow Colombian authors to showcase what they created to the world.

The main goal of the Copyright Office is that the web portal will allow the authors to monetize their creations, therefore facilitating their access to different industries (for example, editorials, record houses, film producers, software companies).

The author is required to register her works before the Copyright Office and can then access a portal in which she can choose which works would be published.

The Copyright Office estimates that of 68,069 literary and artistic works in 2016, 50,322 are unpublished.

PERU | Antitrust, Intellectual Property | Antitrust Authority of Peru assumes more powers to remove bureaucratic barriers

On 7 December 2016 -and with the issuance of Legislative Decree 1256/2016-, the Peruvian Antitrust Authority (INDECOPI) assumed more powers to remove bureaucratic barries that prevent the development of free competition.

The Decree deepens the powers of INDECOPI to issue technical reports to the President or the Senate, as it allows to take legal action at its own initiative or at the request of third parties against laws or bills containing potential bureaucratic barriers.
