India and UK take new trademark decisions

The evolution of trademarks and the growing interest of their owners in defending them has led to an increase in confrontations between globally recognized trademarks and third-party applications that could be similar.

Thus, the decisions of international authorities acquire a crucial relevance in the positioning of trademarks. Here are two recent decisions from India and the United Kingdom.

The New Delhi Court refused the registration of the trademark “VIGOURA” requested to protect sexual disorder drugs, as it considered that it is phonetically similar to Pfizer’s well-known trademark “VIAGRA”, which identifies drugs for erectile dysfunction.

Despite Louis Vuitton’s attempts to prevent the registration of the trademark “L V Bespoke”, requested to identify metal and plant goods in the United Kingdom, the authorities considered that the trademarks belonged to different market areas and, therefore, could coexist.
