Constitutional Court has unified the appeal regime established in the General Code of Process (GCP), through decision SU-418.
The decision was taken after analyzing four cases in which evidence was found of the existence of contrary positions in civil jurisdiction regarding the processing of appeals, which creates a clear violation of the right to equality of citizens who access the justice system.
The Court stated that in order to achieve uniformity in judges decisions, the appeal must be sustained before the superior court in a support and ruling hearing. Not doing so would be grounds for the court dismissing the appeal.
