Brazil: The Brazilian Patent Office publishes Resolution regarding the use of examinations from other countries

On 30 October 2018, the Brazilian Patent Office published Resolution No. 227/2018establishing that the result of searches carried out in other Patent Offices worldwide could be used in the country to expedite examination of pending applications.

The resolution applies to applications that have not yet undergone a first technical examination, that have not requested any type of priority examination before the Patent Office, that do not contain a petition for subsidies to the examination or the opinion of the Brazilian Health Regulatory Agency (ANVISA in Portuguese), and that the applications have searches in prior art already performed by other Offices or Organizations.
