Peru: Trade Association and Free Competition Draft Guide

On 28 December 2018, the Peruvian Competition Office (INDECOPI), published the Trade Association and Free Competition Draft Guide.

The draft Guide identifies common trade practices that facilitate anticompetitive behavior such as direct coordination among partners to discuss prices, client lists, market areas and market conditions or variables under which negotiations of goods or services are carried out (discounts, sales volumes or others).

The draft guide provides recommendations to trade associations for the adoption of free competition rules within administrative bodies, who must work on preventing unfair competition.

Those interested in submitting their comments on the Project may do so atst.clc@indecopi.gob.pe or by writing to the Peruvian Technical Secretariat of the Free Competition Defense Commission by 31 January 2019. The Peruvian Free Competition Defense Commission is responsible for the approval of a final draft of the guide.
