COLOMBIA | Intellectual Property, Trademarks, Patents | Colombian IP Office updates its fees

On 30 September 2016 -and by means of Resolution 64742 of 2016-, the Superintendence of Industry and Commerce (SIC in Spanish) updated its intellectual property fees.

The fee updates meant an increase of 6.84 % in all filing and prosecution rates of patents, trademarks and others distinctive signs and new creations, which applies from 1 January 2017.  The new fees will be included in the SIC’s main regulation (Circular Única).

COLOMBIA | Corporate Law | Colombia: emails related with the corporate purpose of a company are part of the business correspondence and must be kept

On 28 September 2016, and by means of Concept 220-187987rated under the filing 2016-01-426431-, the Superintendence of Companies (Colombian Authority on Surveillance, Control and Inspection of companies) indicated that data messages of the company related to the development of its corporate purpose / economic activity are part of the business correspondence.

Accordingly, emails and similars must be kept for a period of 10 years, in compliance with the appointed in Article 28 of Law 962 of 2005.  The custody obligation is extensible to emails related to administrative aspects of the company.

MEXICO | Patents | Patent Offices of Austria and Mexico signed an agreement that includes a Patent Prosecution Highway (PPH)

On 25 October 2016, the Patent Offices of Austria (APO) and Mexico (IMPI in Spanish) signed three agreements among them.

The agreements includes: (i) a Memorandum of Understanding related to cooperation in IP matters; (ii) the implementation of a Patent Prosecution Highway (PPH); and (iii) the formalization of recognition of the APO as International Search Authority (ISA) and International Preliminary Examining Authority (IPEA) by the IMPI.

Mexico currently has 13 PPHs in force.

COLOMBIA, MEXICO | Consumer Law | Colombia and Mexico signed a Memorandum of Understanding to strengthen consumer protection

On 28 October 2016, the Colombian and Mexican Authorities in Consumer Law (Superintendence of Industry and Commerce -SIC in Spanish- and Federal Attorney’s Office of Consumer -Profeco- respectively) signed a Memorandum of Understanding, which aims to develop cooperation activities between the two institutions in policies, protection and defense of consumers.

Specifically, the agreement involves the exchange of experiences and information.  Also, implies the exchange of legal and regulatory frameworks developing policies on consumer rights.
