COLOMBIA | Patents, Intellectual Property, Regulatory | Government of Colombia issues Regulation on medicines subject to a Declaration of Public Interest

On 22 november 2016, the Ministry of Health of Colombia through the National Pharmaceutical Price Commission (NPPC) issued Resolution (Circular) 3 of 2016, by means of which it regulates the price of medicines that have been subject of a Declaration of Public Interest (DPI).

The Resolution (Circular) 3 of 2016 turned away from the opinion issued by the Superintendence of Industry and Commerce (SIC) in the framework of the competition advocacy procedure, stipulating in the Resolution that the medicines subject to price control must have as maximum sales value, the lowest price of all competitors in the countries of reference.

At the same time, the NPPC published the draft of Resolution (Circular) 4 of 2016, applying Resolution (Circular) 3 of 2016 to Glivec.  As for the draft of Resolution (Circular) 4, there is a deadline for comments until 5 December 2016.

LATIN AMERICA | Patents | Latin American Patent Offices updated their information in the PCT Applicant’s Guide

On 25 November 2016, the World Intellectual Property Organization (WIPO) informed which countries updated their information in the PCT Applicant’s Guide.  The next Latin American Patent Offices updated their information:

  • Information as Receiving Offices (Annex C): Belize, Chile, Costa Rica, Cuba, Dominican Republic, Ecuador, El Salvador, Guatemala, Honduras, Mexico, Nicaragua, Panama, Peru and Trinidad & Tobago.
  • Information as International Searching Authorities -ISA- (Annex D): Brasil and Chile.
  • Information as International Preliminary Examining Authorities -IPEA- (Annex E): Chile.

 

UNITED KINGDOM, EUROPEAN UNION | Patents | Despite Brexit, UK would ratify Unified Patent Court

On 28 November 2016, the UK Government confirmed that it is proceeding with preparations to ratify the Unified Patent Court Agreement (UPCA).  Even if the above does not mean that the UK has taken a decision, it raises important expectations of ratification.

The UPCA will allow the implementation of the Unitary Patent and the Unified Patent Court for all members of the European Union.

MEXICO | Industrial Property | Mexican Patent Office enables electronic notifications

On 22 November 2016, the Mexican Institute of Industrial Property (IMPI in Spanish) enabled the online notification service regarding the requests received by the Office.  The service will be provided to those users who expressly request the use of electronic notifications.

WORLD | Intellectual Property | WIPO issues annual report on World Intellectual Property Indicators

On 23 November 2016, the World Intellectual Property Organization (WIPO) issued the annual report of world intellectual property indicators in its 2016 version.  Among the most relevant aspects of the report -made with data from 2015- highlights the increase in the filings of industrial property applications.  In the case of patents, the applications increased by 7.8% compared to 2014 (from 2.680.900 to 2.888.800 applications).  Trademarks applications increased 15.3%, from 5,187,900 applications to 5,983,000 and industrial design applications increased from 853.500 to 872.800, with a growth of 2.3%.
