New edition of the Nice classification

A new edition of the International Classification of Goods and Services for the Purposes of the Registration of Trademarks (“Nice Classification”) will enter into force on January 1st, 2023. This twelfth edition includes several changes.  Although it does include additional classes, it does have changes associated with the addition, delimitation, and extension of some products and services. Among the main modifications are: 

  • An additional description was introduced in class 9 referring to NFTs (“Downloadable digital files authenticated by non-fungible tokens”) 
  • In class 36, the term “financial business” changed to “financial services.” 
  • In class 41 (education, training, sporting, and cultural activities), the service “Online provision of virtual guided tours” was added. 
  • Class 45 included pet-sitting services. 

Choosing the correct set of classes for products and services is one of the crucial aspects of Trademark protection. The Nice Classification is updated continuously and is constantly under revision as it is a tool for Intellectual Property Officers and Trademark owners to properly appoint different types of products and services related to the Trademark.
