The European Data Protection Board has updated the Guidelines on consent, focusing especially on granted consent through notices and use of cookies. For example, including provisions on pre-ticked consent boxes, opt-out buttons, improper sorting, among others.

Although these Guidelines are not legally binding and do not generate sanctions for non-compliance, it should be noted that they include good practices that regulatory authorities may consider in terms of personal data protection compliance.

Although cookies are not expressly regulated in Colombia, Colombia’s Data Protection Authority (SIC) has recognized that they are covered under Colombian Personal Data Protection Regulations. Accordingly, these new guidelines constitute good practices to be considered in Colombia, even though they are not binding. Likewise, companies in Colombia should consider that those who have a compliance system in this matter responding to good international practices, can establish commercial relationships at an international level with greater ease due to their capacity to respond to these terms.
