Colombia: Trademark Office protects ancestral practices of the Colombian Pacific coast and cancels the Viche del Pacífico trademark

On 12 October 2018, the Colombian Trademark Office (SIC in Spanish), through Resolution Nº 77612, cancelled the registration of VICHE DEL PACIFICO trademark as it is a genericized trademark to designate alcoholic beverages.

The Trademark Office (SIC) concluded that VICHE DEL PACIFICO is a product of ancestral origin, and its name dates back to Colombia’s colonial era.  The name does not originate from the creation of the owner of the registry, but instead from the name that several generations of certain communities from the Colombian Pacific region had given this characteristic beverage, produced by those having this inherited knowledge.
