The Guideline looks to inform users of the BPTO’s internal procedures for design applications. For the first time in Brazil, users will have a concise document explaining how designs must be filed, the BPTO’s procedure for priority request analysis, the mandatory views required in design applications, among other matters.
The BPTO Guideline showed an improvement regarding the acceptance of figures that show how the claimed object can be used or applied. However, in order to seek protection, stating within the application that its use is not part of the scope of protection, is mandatory.
